This privacy policy applies only to the websites, mobile applications, and other online platforms controlled by CodeHouse and/or its subsidiary and affiliated entities (“CodeHouse,” “we,” “us” or “our”) and anywhere this privacy policy is posted for CodeHouse to offer its activities and services (collectively, the “Sites”). This privacy policy does not govern information that is collected offline. BY USING THE SITES, YOU CONSENT TO THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY AND TO OUR PROCESSING OF PERSONALLY IDENTIFIABLE INFORMATION FOR THE PURPOSES STATED BELOW. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY, PLEASE DO NOT USE THE SITES.

 

A.  Information Collected

This privacy policy applies only to information collected on the Sites and does not apply to information CodeHouse collects through any other means. Please see Section (D) “Collection and Use of Information from Children” below for further information on data collected from children under 13. “Personally Identifiable Information” or “PII” is information that identifies you personally, such as your name, address, telephone number, email address, or company name. CodeHouse collects and stores the PII that you have provided to us. Some examples of manners in which we may collect your PII on the Sites include:

 

(1) Active Collection

We collect and store PII from you directly, at the time you supply information to us via the Sites. If you do not want CodeHouse to collect your PII, please do not provide it to us. The information we actively collect from you may include:• Email address, first and last names, telephone number, and billing and shipping information if you provide it via the Sites, such as to sign up for an event or to sign up as a CodeHouse partner;• Email address, first and last names, telephone number, and billing information if you donate to CodeHouse or make a purchase via the Sites;• First and last name, date of birth and email address if you choose to participate in a contest or giveaway;• First and last name, and email address if you contact us with a question.

 

(2) Passive Collection

We may collect information passively while you are visiting or interacting with the Sites. We call this “passive” collection because you may not know this information is being collected. The information we passively collect from you may include:

• Internet Protocol (IP) address – Your IP address is a number that lets computers attached to the Internet know where to send you data — such as the webpages you view. We may use this information to deliver our webpages to you upon request.• Cookie – A “cookie” is a small text file that may be used to collect information about your activity on the Sites. For example, when someone visits a page within the Sites, a cookie may be placed on the user’s machine (if the user accepts cookies) or may be read if the user has visited the Sites previously. You may set most browsers to notify you if you receive a cookie, or you may choose to block cookies with your browser.• Web Beacons (also known as “clear gifs,” “web bugs” or “pixel tags”) – “Web Beacons” are tiny graphics with a unique identifier, similar in function to cookies, and are used to count users who have visited certain pages of the Sites. When used in HTML-formatted email messages, web beacons can tell the sender whether and when the email has been opened. In contrast to cookies, which are stored on a user’s computer hard drive, web beacons are embedded invisibly on web pages.• Demographic Information – “Demographic Information” may be your gender, age, zip code and interests, which you voluntarily provide to us on the Sites. We may use this information to analyze trends to ensure the information provided by the Sites meets your needs.

B.  Use of Information Collected Via the Sites

We use PII that is collected on these Sites primarily for the following purposes:

• To complete a transaction or service requested by you;

• To obtain consent from parents or schools for the collection and use of information from children;• To notify you about a material change to this privacy policy, if necessary;• To contact you in response to sign up forms such as through our Contacting CodeHouse section;

• To conduct surveys;• If you are entering a giveaway or contest, to fulfill the terms of that giveaway or contest, including sharing your information for prize fulfillment purposes (e.g., with mail carriers and/or partners); 

• If photos/videos of you are taken during an event, we may use photos/videos of you for future marketing purposes, including but not limited to on the Sites; or• As otherwise disclosed at the time of collection.

C.  Sharing and Disclosure of Information

We may share or disclose your PII in the following instances:

a. To complete your purchase. If you choose to make a purchase on the Sites, we may collect from you your credit card number, billing address and other information related to such purchase, and we may use such collected information in order to fulfill your purchase. We may also provide such information, or other PII provided by you, to unaffiliated third parties as necessary to complete your purchase (for example, to process your credit card or to ship your purchase to you).

b. To fulfill a service to you. For example, if you email us a question, we may use your email address to process your request and respond to your question.

c. To partners and affiliates. For example, we may share the schools that participate in our challenges and/or other information with partners and affiliated organizations that may assist with our services and/or be able to assist you.  

d. To unaffiliated third-party service providers, agents or independent contractors who help us maintain our Sites and provide other administrative services to us (including, but not limited to, order processing and fulfillment, hosting and website content management system services, and maintaining and analyzing data). Because such unaffiliated third-party service providers that help us administer our Sites may have access to users’ PII, if you do not wish for our unaffiliated third-party service providers to have access to your information, please do not submit any PII to us.

e. To comply with the law or in the good faith belief that such action is necessary in order to conform to the requirements of law or comply with legal process served on us, protect and defend our rights or property, including the rights and property of CodeHouse and its Sites, or act in urgent circumstances to protect the personal safety of our end users.

f. To third parties as part of any corporate reorganization process including, but not limited to, mergers, acquisitions, and sales of all or substantially all of our assets. Please find more information in Section (H) “Assignment” below.

g. To protect against potential fraud, we may verify with third parties the information collected from these Sites. In the course of such verification, we may receive PII about you from such services.

Except as described in this privacy policy, we do not otherwise use, share or otherwise disclose your PII to any third parties. When we do share information with others, we take steps to require them to treat your information securely and in accordance with applicable law.

D.  Collection and Use of Information from Children

We are committed to protecting the privacy of children who use our Sites. This privacy policy also applies to children’s PII we collect on our Sites. We require parent, guardian, or school consent for use of our Sites by children under 13, in accordance with applicable law. We do not require children to disclose more information than is reasonably necessary to participate on our Sites. 

We collect the following PII from children under 13 and may share this PII as described above in Section (C) “Sharing and Disclosure of Information.” We do not disclose the PII of any child to third parties for any marketing or promotional purposes unless they are acting as our service providers or partners. 

  • First and last name, 

  • Address,

  • Age, grade in school, and school name,

  • Photo/image,

  • Voice/audio,

  • online contact information, 

  • and persistent identifiers (i.e., cookies).

We use the PII collected from children to:

  • To provide requested services on and access to our Sites, 

  • To provide our services, including on other online platforms provided by service providers. Please see below under “Disclosure of Children’s PII” for a link to a list of our service providers and partners,

  • To allow us to assess and improve the services on our Sites, 

  • To conduct surveys, 

  • To maintain and analyze the functioning of the Sites, 

  • To customize, adapt, and personalize viewing and content, 

  • If you are entering a giveaway or contest, to fulfill the terms of that giveaway or contest,

  • As we believe necessary or appropriate to comply with the law or in the good faith belief that such action is necessary in order to conform to the requirements of law or comply with legal process served on us, protect and defend our rights or property, including the rights and property of CodeHouse and its Sites, or act in urgent circumstances to protect the personal safety of our end users, and

  • As otherwise disclosed at the time of collection. 

Parent and Guardian Rights

At any time, parents or guardians may review their child’s PII, direct us to delete their child’s PII, and may refuse to allow any further collection or use of the child’s PII. Parents and guardians may also agree to the collection and use of their child’s PII, but still not allow disclosure to third parties unless it’s part of the requested service. To exercise these rights, please contact us through the Contacting CodeHouse section at the end of the privacy policy. All valid requests will be accommodated within a reasonable time. To protect children’s privacy and security, we will take reasonable steps to help verify a parent’s identity before granting access to any PII.

Parent and Guardian Consent

Consistent with the requirements of the U.S. Children’s Online Privacy Protection Act (“COPPA”), on any child-targeted site or application, or in any instance where we ask for age and determine the user is age 12 or under, we will obtain appropriate consent from parents or schools. If you believe your child is participating in an activity that collects PII and you have NOT received an email providing notice or seeking your consent, please contact us at [INSERT]. We will not use emails provided for consent purposes for marketing, unless the parent or guardian has expressly opted in to email marketing or has separately participated in an activity that allows for such email contact.

In the event we collect PII from a child that will be posted publicly, we will seek a higher level of consent than email consent and will ask schools to obtain appropriate consent. Such “high-level” methods of consent from parents and guardians include but are not limited to speaking to a trained customer service representative by telephone or video chat, or requiring a signed consent form by mail, email attachment, or fax. 

Additional Protections and Information for School Accounts

  • If you have access to the Sites through a school account, additional privacy protections apply because your school may provide CodeHouse with student personally identifiable information (“Student Data”) as defined by the Family Educational Rights and Privacy Act (“FERPA”).

  • CodeHouse will only access, collect, record, organize, use, or disclose Student Data collected through the Sites as described in this privacy policy. Schools are responsible for ensuring that parents are provided links to this privacy policy. 

  • CodeHouse will delete, or if requested by the school, transfer to the school all Student Data within 90 days (or a shorter time frame if required by applicable law) following the termination of CodeHouse’s agreement with the applicable school.

Disclosure of Children’s PII

We may share or disclose PII collected from children in a limited number of instances as described in this privacy policy, including the following:

  • We may share PII with our service providers if necessary for them to perform a business, professional, administrative, or technology support function for us. We may also share PII with our partners to provide our services. A link to our list of service providers and partners can be found here.

  • We may share PII with schools, partners, parents, and guardians in order to obtain appropriate consent to collect and use information from children, as required by applicable law and to provide our services and programs.

  • We may provide the PII in case of sale of our business or assets or merger with another company, and we may disclose PII to the prospective buyer for due diligence purposes and on completion of the assignment, sale, or merger;

  • We may disclose PII if permitted or required by law, for example, in response to a court order or a subpoena. To the extent permitted by applicable law, we also may disclose PII collected from children (i) in response to a law enforcement or public agency’s (including children services) request; (ii) if we believe disclosure may prevent the instigation of a crime, facilitate an investigation related to public safety or protect the safety of a child using our Sites; (iii) to protect the security or integrity of our Sites and other technology, as well as the technology of our service providers; or (iv) enable us to take precautions against liability.

E.  International Transfer of Information

If you choose to provide us with PII, CodeHouse may transfer that information to its affiliates and subsidiaries or to other third parties, across borders, and from your country or jurisdiction to other countries or jurisdictions around the world. If you are visiting from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring your PII to the United States, which does not have the same data protection laws as the EU and does not offer the same consumer rights and protections as EU law, and by providing your PII you understand that: (i) we will use your PII for the uses identified above in accordance with this privacy policy; and (ii) we will transfer your PII to the United States as indicated above, in accordance with applicable law.

F.  Opt-Out

We may communicate with users of the Sites who subscribe to services we offer on a regular basis via email. For example, we may use your email address to confirm your request or order, to send you notice of payments, to send you information about changes to our services, and to send notices and other disclosures as required by law. Generally, users cannot opt-out of these communications, but they will be primarily informational in nature rather than promotional. However, we provide you the opportunity to exercise an opt-out choice if you do not want to receive other types of communication from us, such as emails or updates from us regarding new services and products offered on the Sites. The opt-out choice may be exercised by ticking or un-ticking the appropriate box if such checkbox is available at the points where PII is collected or by contacting us. We will process your unsubscribe as soon as possible, but please be aware that in some circumstances you may receive a few more messages until the unsubscribe is processed. You also may opt-out of receiving such emails by clicking on the “unsubscribe” link within the text of the email.

G.  Third Party Websites

This statement applies solely to information collected on the Sites. The Sites may contain links to other websites. We are not responsible for the privacy practices or the content of these other websites. If you have any questions about how these other websites use your information, you should review their policies and/or contact them directly.

H.  Assignment

As part of any corporate reorganization process including, but not limited to, mergers, acquisitions, and sales of all or substantially all of our assets, you grant us the right to disclose or assign the PII collected via the Sites to third parties following completion of such transaction and/or during the assessment process pending transfer. If transferred in such a case, the third party will abide by the terms and conditions of this privacy policy.

I.  Changes to this Privacy Policy

We reserve the right to change this privacy policy from time to time. When we do, we will revise the “last updated on” date at the top of this privacy policy. If we make material changes to this privacy policy, we will send a notice to the primary email address specified in your account and/or place a prominent notice on the Sites.

J.  Security

No data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you understand that any information that you transfer to CodeHouse is done at your own risk. Once we receive your transmission, we make reasonable efforts to ensure security on our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software. If we learn of a security systems breach we may attempt to notify you electronically so that you can take appropriate protective steps. By using the Sites or providing PII to us you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of these Sites. We may post a notice on our Sites if a security breach occurs. We may also send an email to you at the email address you have provided to us in these circumstances. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

K.  Accessing Your PII and Privacy Preferences

We provide you with an opportunity to access your PII to ensure it is correct, accurate, and current. To edit your PII or to be removed from our mailing list, please contact us at contact@thecodehouse.org. We will make reasonable efforts to accommodate your request.

L.  Your California Privacy Rights and How We Respond to Do Not Track Requests

The “Do Not Track” (“DNT”) privacy preference is an option that may be made in some web browsers allowing you to opt-out of tracking by websites and online services. At this time, global standard DNT technology is not yet finalized and not all browsers support DNT. We therefore do not recognize DNT signals and do not respond to them.

 

California Civil Code Section 1798.83 permits our visitors who are California residents to request certain information regarding CodeHouse’s disclosure of PII to third parties for their direct marketing purposes. We do not disclose PII to third parties for their direct marketing purposes.
